この利用規約（以下「本規約」）は、Nagi Lab（以下「当方」）が提供する Android アプリ「Kiripop」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード、インストール、または利用した時点で、本規約に同意したものとみなします。情報の取り扱いについては、プライバシーポリシーもあわせてご確認ください。

第1条（本アプリの内容）

本アプリは、端末内の写真・画像を端末内で切り抜いてステッカーおよびステッカーパックを作成し、WhatsApp や Telegram への追加やバックアップ書き出しを行えるステッカー作成アプリです。写真の切り抜き処理（Google Play 開発者サービスの端末内 ML Kit を使用）およびステッカーの保存はお使いの端末内でのみ行われ、当方のサーバーに画像がアップロードされることはありません。

第2条（対象年齢・利用できる方）

  1. 本アプリは 13 歳以上の方（および Google Play ストアに表示される対象年齢区分を満たす方）を対象としており、13 歳未満の子どもを対象としていません。対象年齢未満の方は利用できません。
  2. 未成年の方が本アプリを利用する場合は、親権者その他の法定代理人の同意を得たうえで利用してください。

第3条（知的財産権とユーザーが作成したステッカーの権利）

  1. 本アプリの権利：本アプリのプログラム、UI デザイン、ロゴ、アイコン、同梱されているフォント・装飾素材・文章等に関する著作権・商標権・その他一切の知的財産権は、当方または正当な権利を有する第三者に帰属します。
  2. ユーザーが作成したステッカーの権利：利用者が本アプリを使ってご自身の写真・画像から作成したステッカーおよびステッカーパックの著作権その他の権利は、作成者である利用者（または元の画像の正当な権利者）に帰属します。当方が利用者の作成したステッカーの権利を取得することはありません。
  3. 他人の権利を侵害する画像の禁止：利用者は、ご自身が権利を有するか、または正当な許諾を得た写真・画像のみを使用してください。第三者の著作権、商標権、肖像権、パブリシティ権、プライバシー権その他の権利を侵害する画像、またはわいせつ・暴力的・違法な画像を使ってステッカーを作成・保存・配布・共有（WhatsApp や Telegram 等への追加・送信を含みます）してはなりません。
  4. 利用者が作成・使用したステッカーに関して第三者との間でクレームや紛争が生じた場合は、利用者自身の責任と費用において解決するものとし、当方は一切の責任を負いません。また、WhatsApp や Telegram 等の外部アプリへ追加した後の利用については、各外部アプリの利用規約にも従ってください。

第4条（広告）

  1. 本アプリでは、Google の広告サービス「Google AdMob」を利用して広告（操作の区切りに表示される全画面のインタースティシャル広告や、任意で視聴するリワード広告等）を表示します。
  2. 広告の配信、効果の計測、および不正防止のため、Google AdMob により広告 ID（Android の広告 ID）、IP アドレス、端末・アプリの情報、広告の表示・操作記録等が取得・利用されます。
  3. 欧州経済領域（EEA）・英国・スイス等の対象地域では、Google の同意管理プラットフォーム（User Messaging Platform / UMP）による同意画面で広告に関する同意を選択でき、アプリの設定（「広告のプライバシー設定」）からいつでも変更できます。また、Android 端末の設定から広告 ID のリセットや制限が可能です。
  4. 表示される広告の内容、およびリンク先の商品・サービス等は各広告主の責任において提供されるものであり、当方はその内容や安全性・正確性について一切の責任を負いません。
  5. リワード広告の視聴により本アプリ内で解放される機能や特典（報酬）がある場合は、本アプリ内でのみ有効であり、現金・金券・他サービスのポイント等への換金や第三者への譲渡はできません。

第5条（料金・課金）

本アプリの基本機能は無料で利用できます。将来、Google Play の課金機能を利用した有料機能・買い切りアイテム等を提供する場合は、Google Play の決済手段を通じて販売し、返金は Google Play の返金ポリシーに従うものとし、購入時と同じ Google アカウントにより購入済みの復元が可能となります。

第6条（データの保存・バックアップ）

作成したステッカーとパックは端末内に保存されます。アプリのアンインストール、データ消去、端末の故障・紛失等によりデータが失われた場合、当方は復元できません。必要に応じてアプリ内のバックアップ書き出し機能（.zip ファイルの保存）をご利用ください。

第7条（禁止事項）

本アプリの利用にあたり、次の行為を禁止します。

  1. 法令または公序良俗に反する行為
  2. 第三者の著作権、商標権、肖像権、プライバシー権その他の権利を侵害する画像を使用・加工・配布する行為
  3. 本アプリのプログラムやデータの不正改造、改変、解析、逆コンパイル、逆アセンブル、リバースエンジニアリングを行う行為
  4. 自動化ツールや不具合の意図的な悪用など、不正な方法で本アプリを操作する行為
  5. 広告の表示・クリック・リワード取得の仕組みを不正に操作・妨害する行為
  6. 当方または第三者のサーバー・ネットワークに不正にアクセスし、または過度な負荷をかける行為
  7. 本アプリ自体または本アプリの同梱素材を、当方の許可なく転載・再配布・販売する行為
  8. その他、本アプリの運営を妨げる行為、または当方が不適切と判断する行為

第8条（免責事項）

  1. 当方は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、外部アプリとの連携の継続性、エラーやバグなどを含みます）がないことを明示的にも黙示的にも保証しません。
  2. 当方の故意または重大な過失による場合を除き、本アプリの利用または利用できなかったことによって利用者に生じた損害について、当方は責任を負いません。
  3. 消費者契約法その他の法令により当方が損害賠償責任を負う場合であっても、当方の故意または重過失による場合を除き、当方の賠償責任は利用者に直接かつ現実に生じた通常の損害に限り、かつ利用者が当方に支払った本アプリの対価の総額（無料でご利用の場合は 1,000 円）を上限とします。

第9条（本アプリの変更・中断・終了）

当方は、事前の告知のうえ（やむを得ない場合は事前の通知なく）、本アプリの内容を変更し、または提供を一時中断もしくは終了することがあります。

第10条（本規約の変更）

当方は、民法の定型約款の規定に基づき、必要に応じて本規約を変更することがあります。変更後の本規約は本ページに掲載した時点（または別途定める効力発生日）から効力を生じ、変更後に本アプリを利用した場合には変更後の規約に同意したものとみなします。

第11条（準拠法・管轄裁判所）

本規約は日本法に準拠し、日本法に従って解釈されます。本アプリまたは本規約に関して紛争が生じた場合は、当方の所在地を管轄する地方裁判所または簡易裁判所を第一審の専属的合意管轄裁判所とします。

Kiripop — Terms of Use

These Terms of Use (the "Terms") govern your use of the Android application "Kiripop" (the "App") provided by Nagi Lab ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. Please also review our Privacy Policy.

1. The App

Kiripop is a sticker maker app that lets you cut out photos on your device (using Google's on-device ML Kit via Google Play services), organize sticker packs, add them to WhatsApp or Telegram, and export backups. All photo processing and sticker storage happen locally on your device; your photos and stickers are never uploaded to our servers.

2. Eligibility and Age Rating

  1. The App is intended for users aged 13 and over (and who meet the age rating shown on Google Play) and is not directed to children under 13.
  2. If you are a minor in your jurisdiction, please obtain consent from your parent or legal guardian before using the App.

3. Intellectual Property and User-Created Stickers

  1. Our Rights: All rights, title, and interest in and to the App itself—including its software code, UI design, logos, icons, and bundled assets or text—belong to Nagi Lab or its licensors.
  2. Your Stickers: You (or the original rightsholder of the source images) retain all rights to the stickers and sticker packs you create using your own photos and images in the App. We claim no ownership over the stickers you make.
  3. No Infringing Images: You must only use photos and images that you own or have permission to use. You must not use images that infringe any third party's copyright, trademark, portrait rights, publicity rights, privacy rights, or other rights, nor any unlawful, obscene, or harmful content when creating, exporting, or sharing stickers (including adding them to WhatsApp or Telegram).
  4. You are solely responsible for the stickers you create and share, and for resolving any disputes with third parties arising from them. When exporting stickers to third-party apps such as WhatsApp or Telegram, you must also comply with those platforms' terms of service.

4. Advertising

  1. The App displays advertisements through Google AdMob (such as interstitial ads shown between actions and optional rewarded ads).
  2. To serve and measure ads and prevent fraud, Google AdMob collects and processes the Android Advertising ID, IP address, device and app information, and ad interaction events.
  3. Users in the European Economic Area (EEA), the United Kingdom, and Switzerland are asked for consent via Google's User Messaging Platform (UMP) and can change their choice at any time from "Ad privacy settings" in the App. You can also reset or limit your Advertising ID in your device settings.
  4. The content of advertisements and any linked products or services are the sole responsibility of the respective advertisers. We do not endorse and are not responsible for third-party ads.
  5. Any in-app rewards or features unlocked by watching rewarded ads are valid only within the App, have no monetary value, and cannot be redeemed for cash or transferred to third parties.

5. Pricing and In-App Purchases

Core features of the App are free to use. If optional paid features or one-time purchases are offered via Google Play Billing, payments are processed by Google Play, refunds follow Google Play's refund policy, and purchases can be restored using the same Google account.

6. Local Storage and Backups

Your stickers and packs are stored only on your device. If data is lost due to uninstallation, clearing app data, or device loss/damage, we cannot recover it. Please use the backup export feature (.zip file) to keep your own backups.

7. Prohibited Conduct

You agree not to engage in any of the following:

  1. Violating any applicable laws, regulations, or public order and morals.
  2. Using, processing, or distributing images that infringe the intellectual property, portrait, privacy, or other rights of third parties.
  3. Modifying, tampering with, decompiling, disassembling, or reverse engineering the App.
  4. Using automation tools or intentionally exploiting bugs.
  5. Manipulating, spoofing, or interfering with ad display, clicks, or rewarded ad mechanisms.
  6. Gaining unauthorized access to or placing excessive load on our or third-party servers or networks.
  7. Redistributing, selling, or commercially exploiting the App itself or its bundled materials without permission.

8. Disclaimer and Limitation of Liability

  1. The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including fitness for a particular purpose, non-infringement, or uninterrupted compatibility with third-party apps.
  2. Except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages arising from the use of or inability to use the App.
  3. Where our liability cannot be excluded under the Consumer Contract Act of Japan or other mandatory laws (excluding willful misconduct or gross negligence), our total liability shall be limited to direct and ordinary damages, up to the total amount you paid for the App (or 1,000 JPY if you use the App free of charge).

9. Changes and Termination of the App

We may modify, suspend, or discontinue the App or any of its features at any time, with or without prior notice.

10. Changes to These Terms

We may update these Terms from time to time. Updated Terms take effect when posted on this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising out of or relating to the App or these Terms shall be submitted to the exclusive jurisdiction of the court having jurisdiction over the location of Nagi Lab in the first instance.
